Terms of service

1. Definitions

“Company”, “we”, “us”, or “our” means Portfolio Lash Academy or Portfolio Beauty Academy.
“Customer”, “you”, or “your” means the purchaser of a course.
“Course” means any training, workshop, digital training, or online learning provided by us.

2. Booking & Payment

Bookings are confirmed when payment (deposit or full fee) is received.
We reserve the right to refuse or cancel bookings at our discretion.

3. Digital / Online Courses

3.1 Access to digital or online training content is provided for personal use only.
3.2 Course materials must not be copied, shared, recorded, or redistributed.
3.3 Where digital content access is provided immediately after purchase, you acknowledge that you may lose any applicable cooling-off cancellation rights where permitted by law.
3.4 We are not responsible for technical issues outside our control including:

Internet outages
Customer device issues
Third-party platform failures

4. Trainer Conduct & Right to Remove Attendees

4.1 We reserve the right to refuse admission or remove any participant from a course where behaviour is:

Disruptive
Unsafe
Abusive or threatening
Under the influence of drugs or alcohol
In breach of course rules or instructions

4.2 No refunds will be given where a participant is removed for conduct reasons.

5. Limitation of Liability

To the fullest extent permitted by law, we are not liable for:

Loss of income, business, or profits
Travel or accommodation costs
Indirect or consequential loss
Personal circumstances affecting attendance

Our total liability shall not exceed the amount paid for the course.

Nothing excludes liability for:

Death or personal injury caused by negligence
Fraud
Any liability which cannot legally be excluded

6. Chargeback & Payment Dispute Terms

6.1 By completing checkout, you confirm that:

You have read and accepted our Refund Policy and Terms
You understand courses are non-refundable subject to policy terms
You authorise us to supply services on the booked date

6.2 Customers agree to contact us first to resolve any payment dispute before initiating a chargeback.

6.3 Where a chargeback is raised, we reserve the right to provide Shopify, payment processors, and banks with evidence including:

Policy acceptance at checkout
Booking confirmation
Course attendance or access logs
Communications relating to the booking

6.4 Where a chargeback is found to be invalid or abusive, we reserve the right to:

Recover outstanding balances
Charge reasonable admin costs
Refuse future bookings

7. Force Majeure

We are not liable for failure to perform due to events outside our control including:
Severe weather, illness, government restrictions, venue issues, or transport disruption.
